i got jumped

i got jumped tonight. at about 2a.m.

there is this ghetto wanna-be a**hole that lives just east of fourth street on poplar - he lives with his mom - his mom is a doctor of some sort - he and his friends just jumped my friend and i on our way home. i am pretty banged up up. some girl walked walked by and told the cops that we were all involved. she was a *****. i said nothing to these guys and got beat down for no reason. i called the cops three different times and had three different cars come out until a supervisor came out. i still don't feel like anything will be done. i know where this guy lives and i won't do anything for sake of law, but i know what happened. here are pics of my face tonight:

This is fairly common in the legal field.

First, take lots of pictures. Second, go see a doctor. Then go see a personal injury lawyer. (if you don't know one, I know plenty)

You can sue the kid for battery and assault.

In terms of criminal charges, if the cops won't do their jobs, you can file a complaint directly with the District Attorney.

Potts--for starters that really sucks. Is your friend ok?
Follow Jordan's advice. In these cases you can do more financial damaged to your assailants. The more pictures you have the better.
If you are having problems with the criminal aspect of what happend send me an email. I don't call the Police for information about things like this but I have a very good friend who does. If there is more that needs to be done let me know.
Regardless of what led up to what happened the if you and your friends did not throw the first punch then you are entilted to have your assailants prosecuted to the fullest extent of the law.
If your assailants attempt to contact you or intimidate you call the Police. Also let me know so I can get on it. I have good relations with the 6th and the 26th so if there is anything I can do to help please let me know.

that's so f#*cke@d up. what's worse than garbage ###holes starting fights for no reason is sissy punks who jump people. i hope you feel OK today potts - seeing that picture of your face all busted up makes me want to go find these ****** right now (and i don't even know you, but i've been jumped and have an idea of how angry you and your friends are).

in the end though, they're not worth it and they're trash. don't stoop down and get yourself in trouble. follow through the legal channels and make sure they don't skate off scott-free, and know that someday it will always come back around for "tough" guys like that.

Dude, that is so ****ed up. If the kids you refer to are the ones I am thinking of...I would go to their mom (she is a nurse, not a dr) and talk directly to her. she will kick the everloving crap out of her kids if she knew what was going on. she seems to keep them on a tight leash.

I live at 4th and Poplar and keep an eye on these kids - especially the short one with the silly facial hair. He drives a green sedan and i watch him when i am out.

Please take the advice above and dont let these punks push you around. If they approach you, call the police. It's spring clean up and lets get the trash off the corner.

I got home too late last nite to help/witness - i walked by when the police were there.

I am truly appreciative of the replies you guys left. I am doing okay - but my whole head stll feels, well, it got the crap beat out of it. I have followed up with the police about this yet - I've been kind of unure how to pursue this. I could use some help as what to do.

Jordan - I believe I am going to follow your advice and try to do something about this. If was just some simple scuffle I'd just let it be - but defintely thr worst I have ever gotten.

And Heather I am also going to send you an email to see what info you can help guide me with as far as the police go.

I called the cops three different times that night and had them send three different units out to try and get something done but they kept acting like there was nothing they could. I even got them to send a Captain out because I was extremely displeased with the way the cops were treating the situation and myself.

My friend is fine, as he was only really help down while the other three kids pummeled me.

Thanks everybody. Your concer made me feel a little better. You're good people.

Potts, not to be an alarmist, but have you had a doctor check you out? It sounds like your head took a bit of a knocking, and your writing was a bit messy in your last couple of posts, not that that's a "major" warning sign or anything given the fact that your in pain and are probably a bit stressed from the hits. Still if your still in pain more than a day after the assault, you ought to have a head trauma check. Plus, a medical record will help with the paper trail in holding the little punk civilly or criminally accountable for his actions. I'd stay away from booze and/or painkillers besides ice until a doc clears them for use.

If anyone knows Potts off the board, please pass along this message. If there's anything to his injuries, sooner is always better than later when it comes to getting them checked out.

Thanks Steve and My favorite Sandwhich. I am doing okay. I'm in a lot pain today - bruises on the back of my head and the whole left side of face etc, but doing okay. Thankfully it was not worse. I definitely had a pretty bad concusion(s) but I think I will be alright. I am following your advice as well as Jordan's to try and ensure legal action is taken. I'd like to do things the old fashioned way - but I'm not that kind of guy. I am just a peaceful dude.

I am going to call the police right now to follow up on this and verify that do have the reports (nothing was given to me). Of the three times I had the cops come out to try and get the guys involved arrested nothing really seemed to be done. I am pretty disgusted by the way it was handled. I was intoxicated when it happened (as I was coming home from the bar) and they seemed to treat me like criminal.

I am not sure which district dispatched the officers.

And for the record - the kid who lives there is about 5'5, with the some spanish or puerto rican in him I think though he is fairly light skinned. And he pretty much just looks a little wanna ghetto banger. I will try and get a picture of him to post. He was not the guy who actually hit me. He assualted my friend as we were walking by on the way home and then his three friends just came at me and started pumelling me. All I did was try to protect my face because there was nothing I could do. One the guys who attacked me was black and had long thing dreadlocks and was approx. 5'9', and one of the other ones was white about 5'6" and looked like an albino or something.

I'll keep you guys posted on anything I find out.

I really appreciate your concerns. it means a lot to me.

If you plan on suing this guy or pressing charges with the DA you're going to NEED to see doctor. Especially if you end up suing.

Jordan - I am not normally the lawsuit type, but I am seriously considering filing a suit against these people. I am following your advice and definitely going to a doctor tomorrow after work to get looked at and to have it documented. I have also photographed my injuries.

How do I go about filing suit? Could you point me in the right direction? Perhaps recommend a personal injury lawyer? I have never gone through anything like this before.

My only concern in this case is I'm not sure if the defendant is worth going after. ie-- if you win a judgment, will you be able to collect? You'll have to ask Bob. I'm not sure if you can collect against their car insurance company.

Hey make sure you call me. Sorry I didn't get back to you earlier. Our van was broken in to last night so we spent the day getting the window fixed. It was parked right in front of our house. We were so tired we didn't hear anything. The only thing stolen was the center console with about $2 in change. Very annoying. Oh, and if you are having blurred vision, your pupils change in size, you get a nasty head ache or vomit get to an emergency room. Seriously. Either way you absolutely need to see a doctor.

So sorry to hear/see your ordeal. It particularly hits home hard since I was messed up pretty good in December in Center City. I was hopeful at the time that the law would prevail, however at this time we are still waiting for witnesses to come forward. Even though it happened at a busy restaurant people seem to have amnesia. Long story short I feel your pain bro. I am a quasi-big dude and a U.S. Marine and can most certainly handle my own, however evidently this kind of thing still happens. Keep on keeping on my friend. Time heals all wounds and this too shall pass. Blah, blah, blah..I know. However it is true. Tell on those lil sh**s. Nothing worse than a momma bear embarrassed. Not even the law can trump that. For real. Dime those lil thugs out. Plus I got your back. Just look for the dude who wears rasta colored flops wherever he goes. That is where you shall find me.

This is an absolute outrage that it was done by a neighbor. If the cops won't do anything then sue...if his mother is the nurse who drives the fancy mercedes then maybe you have a chance to actually recover a judgement.

Where did this happen? On their property? In the street?

The problem is I'm almost positive you can't sue the mother for the actions of her children. Even if the children are under 18 years old. If the kid doesn't own anything, getting a judgment against might be worthless unless you can tack on an insurance company.

If it happened on their property you might be able to go after their homeowners insurance.

hey all...

I spoke with Heather and she is doing all she can for me trying to get the cops to pusue action against these guys. I am waiting hear back from her but I will keep you all posted. She was going to speak directly with the captain. Heather was extremely helpful and very kind. Thanks Heather : )

Jordan, I'll definitely give you a call. I have to lay down right now though. I've been on the phone with all kinds of people this morning and I gotta lay down - my head is pounding. I appreciate you following up on this with me. I did call Bob, and he was helpful. He did not sound sure that it would be worth going after these guys since it might be expensive and we might not get anything. However, I am really interested to hear what the guys at your firm are thinking. Also, it might be easier to prove my side of the case if/when the police take further action.

First off, what happened to Potts is contemptible. It really turns my stomach and I wish I could have been there to help. My girlfriend and I left the Ministry of Information and walked by 4th and Popla shortly before this happened, and I suppose I am lucky.

The remainder of this post is goint to sound boorish and likely spawn some controversy, but I feel I have to at least broach the topic. I don't mean to incite anything.

All this talk about suing this kid or his mom sort of eats at me. I mean, what can a monetary settlement really achieve? To answer that question, Potts would first need to articulate what his goal is. Does he want to punish the kid? His mom? Does he want to make sure the kid never does this again? Or does he want to trade a butt beating for some cash? All are legitimate goals, but I have a feeling that Potts wants something closer to justice than a payday.

As for me, I would punish this kid as much as possible. Which could mean financially punishing his mother, too.

First, you need to get the cops moving on a criminal case. Heather seems to be doing that, and that's good. (And I am absolutely shocked that someone has to beg the police to take action in this case. Isn't this what the do for an f'ing living? Isn't this why we are PAYING them?) Maybe everyone here just assumed that these kids would be put behind bars, but frankly, this string of posts seems too financially bent for my liking. Now what does persuing a criminal case accomplish in my opinion? Not much. The kid will be on the streets in no time, and here's the kicker, he'll be more of a thug. However, it does establish a criminal record and let's face it, being in jail for any amount of time sucks hard.

Second, persue the civil case. Why? Well, why not? Plus, it teaches the mother a lesson (if you believe she is at all at fault, of which I am not sure).

Third, and I expect that this where most people will become upset, this kid needs treble the pain Potts received. I grew up in a rough area and I learned this: Some people are only persuaded by one thing, a punch in the face. And that sucks, but I have been forced to admit to myself that mankind is less evolved than we wish it were. Man, it really depresses me to say this because superficially it sounds so stupid. But it's an unfortunate fact of life. In order to deter this kid, he needs to personally feel extreme pain and humiliation. I wish MLK's sentiments about violence only leaving the world blind and toothless were more than just unfounded optimism, but that's not been my experience. And it's also been my experience that if you are passionate about something that requires action, you need to do it yourself. (Here's where my trust in anarchy over democracy rears its head.)

I can be more persuasive and articulate on these subjects, but for now, I am just P.O.'ed!

This all said, I want nothing more than Potts to obtain his goal - whatever it is. And Potts, now that I know what you look like, if I see you out, I'd like to buy you a beer. Get well, neighbor.

While it'd be nice to just sue people for all of the wrongs they committed, the problem is that it's probably more expensive to sue them then what you'll collect.

If Potts feels like paying a lawyer $250+ an hour in order to get a verdict which he'll never collect, go for it.

I'm not sure an attorney will take this on a contingency fee basis (ie- attorney gets paid if he gets paid). The problem is the kid probably doesn't have any money or assets. You can't sue the mother for the actions of her child. Most homeowners insurance policies have a clause in there against intentional actions (ie- beating someone up).

I'm looking into ways around it, to get him a lawyer on a contingency basis might be tough since there are very little monetary damages...

Long story short, if there's no insurance company involved or the kid isn't rich, no lawyer is going to want the case. I'm working on seeing if there's a way you can sue the insurance company.

If you're looking to pursue a civil case, and want to trigger homeowner's insurance coverage, the thing to do is pursue a negligence claim against the parent(s) for failing to properly supervise the thugs (assuming they're minors) who live under their roof.

More importantly, if the identity and location of these criminals is known, why have they not been arrested? Why is it necessary for Heather or anyone else to have to pressure the cops to do their job?
