Judge Mark Shames

Who filed to have Terri's feeding tube removed in 1997? Judge Mark Shames wasn't involved directly in the actual case [asking for court permission to remove Terri's feeding tube].

According to the Schindlers' site:

In 1997, Michael Schiavo sought out the services of attorney George Felos, a right-to-die litigator.

[ Actually Felos was involved in 1995]

In May of 1998, Felos filed a Petition to Withdraw Life Support. The court appointed a Guardian ad Litem to investigate the merits of this petition and he reported to the court that the petition should be denied, based on conflicts of interest by Michael Schiavo.

Shames actually had a conflict of interest with Schindlers because he had consulted the Schindlers on the first guardianship suit. Michael attempted to remove te feeding tube without involving the Schindlers. Shames balked, and informed Debbie Bushnell that the Schindlers would have to be involved in the process.

Campbell also bought out Shames law firm when he became a judge, so there hint of conclict of interest there as well.

Michael tried to do an end run around the Schindlers. If Michael simply removed the feeding tube on his own accord, it is likely that Michael would have faced another major lawsuit from the Schindlers. Michael would have been subjected to the "Hell" he claimed from the first guardianship suit. Michael retained Felos and was prepared to go to court to seek removal of the feeding tube without ever involving or telling the Schindlers. However, Judge Shames stopped Michael from doing this because he believed that the Schindlers were "interested parties" who had a right to be involved.

Remember, Michael had a hearing on Terri's incapacity without ever telling the Schindlers (they claimed that they were never informed and Michael was appointed guardian without any say from the Schindlers).

Michael also consented to the first UTI treatment refusal in total secrecy of the Schindlers.

Michael said that he would have told the Schindlers sooner or later of what he had done.
